Trump Administration Criticizes New York Green Light Law

Green Light Law

New York Green Light Law

A new law allowing undocumented immigrants to obtain driver’s licenses in the state of New York has attracted criticism from the Trump administration. Attorneys from the U.S. Department of Justice have expressed their opinion that some aspects of this new law may be unconstitutional. Additionally, a lawsuit has been filed by Frank Merola, the clerk of Rensselaer County, stating that enforcement of the New York Green Light Law could result in potential prosecutions of clerks who honor the state law in preference to federal regulations. Working with a qualified and knowledgeable New York immigration lawyer is the best way to resolve any problems with visas, driver’s license applications, and deportation by Immigration and Customs Enforcement (ICE) and other federal authorities.

Understanding the Green Light Law

New York’s new regulation allows for the issuance of driver’s licenses to undocumented immigrants. Formally known as the Driver’s License Access and Privacy Act, the legislation was approved on June 17, 2019, and went into effect on December 16, 2019. It allows all residents of the state of New York to apply for non-commercial driver’s licenses or learner permits without providing proof of legal residence or presenting a Social Security Number. Prospective drivers will still need to provide documentation that verifies their name, date of birth, and residency in the state of New York. Verification can be achieved by presenting a valid foreign passport, consular identification document, foreign driver’s license, a Permanent Resident Card, Employment Authorization Card, foreign birth certificate, foreign marriage or divorce record or a Border Crossing Card.
