A ruling handed down by U.S. District Judge Elizabeth Wolford upheld the right of New York to issue driver’s licenses to undocumented immigrants within the state. Judge Wolford dismissed a lawsuit levied by Michael Kearns, the County Clerk of Erie County, who argued that New York’s Green Light Law was in conflict with federal regulations regarding immigration. According to Judge Wolford, Kearns lacked the proper standing to bring the lawsuit because he had sustained no injury under the new law, which is scheduled to go into effect in December of this year. This is good news for New York immigrants who depend on the ability to drive to provide for themselves and their family members.
The Details of the Green Light Law
Assuming that no further roadblocks are forthcoming, the new Green Light Law will take effect on December 14, 2019. This new law will allow New York immigrants to use foreign passports, foreign driver’s licenses and expired foreign driver’s licenses to prove their identity. They would still have to pass a driving examination and prove their age to obtain a license to drive in the state of New York. The license issued to these individuals will not comply with federal REAL ID requirements and will be emblazoned with the words “Not for Federal Purposes” to ensure that they cannot be used improperly by the individuals to whom they are issued.
