An Immigration Judge recently granted a German couple asylum because they had been fined and threatened with loss of custody of their children for being homeschooled. The parents objected to what was being taught them in public schools, namely the school’s curriculum was not consistent with their religious values. The couple was granted asylum in the U.S. because they were persecuted for refusing to comply with Germany’s mandatory school attendance requirements. Many countries in Western Europe and South America such as Germany, Spain, and Brazil do not allow children to be educated at home and countries like Sweden severely restrict it. In the U.S. all 50 states allow it. Therefore we may expect that similar cases will arise in the U.S. Immigration Courts soon.
