They may be used to apply for permanent residence, within the U.S., provided the applicant is in lawful status. The Labor Certification requires confirmation from the Department of Labor that there is neither a qualified nor available American who can perform the job the applicant does. The applicant must receive the prevailing wage in the area where he will be working; and prove previously acquired necessary skill and education to fulfill the requirement of the job and that the employer has the capacity to pay the prevailing wage as determined by the Department of Labor. A Labor Certification may also be applied for an alien who is outside the U.S.
