FOREIGN WORKERS
For temporary or permanent worker visas who are abroad or are
within the U.S. a job offer is required. Applicants must show
that labor and immigration criteria are met such as specialty
work experience, qualifying educational and job training.
An applicant in the U.S. must prove lawful status.
An applicant abroad must show he/she has not previously remained
in the U.S. illegally for more than 6 months.
Work Visa
A foreign worker may also be transferred from a foreign company
to an affiliate, subsidiary or parent in the U.S. of the
foreign
company, if the applicant has been employed by the foreign
entity for at least 6 months during the past 3 years and
if transferred
in a managerial/executive capacity and/or with specialized
knowledge. Some intra-company transferees may have a fast-track
to a green
card.
If an alien has qualified skills not available by American
workers, he/she may be able to obtain permanent residence
through the
Labor Certification Process.
