After a job offer is obtained in the U.S., the employer must demonstrate the ability to pay the Department of Labor’s prevailing wage for the job category, and place of employment, and advertisements are made in newspapers of general circulation to prove that there are no qualified or available workers.

Other recruitment efforts may be necessary, as well. A preference and adjustment of status may be applied for at the time of the adjustment application provided the applicant is in lawful status. Approval to work normally is granted within 2 months after the filing of the adjustment application.

The employer must prove that it has the capacity to pay the prevailing wage for the job category and that the immigrant who seeks lawful residence through the Labor Department has the education and qualifications for the job category.
If the applicant committed a crime or overstay in the U.S., it may affect the immigration process.
