FOR SPOUSES OF U.S. CITIZENS WHO
ENTERED WITHOUT VISAS:
Unless
protected by the Life Act, that is, an alien relative petition
or a Labor Certification was filed before April 30, 2001, adjustment
of status in the United States is not available, and then the
alien must return to his/her country to apply for an immigrant
visa abroad. The U.S. citizen spouse would have to file for
a waiver at the U.S. Consulate in the spouse’s country
or residence. If a waiver is granted, the foreign spouse may
re-enter the U.S. as a permanent resident.
