SPOUSES OF U.S. CITIZENS WHO ENTERED WITH A VISA AND SEEK PERMANENT RESIDENCE

A U.S. citizen may apply for his/her alien spouse if the spouse is in the U.S. The petition can be done simultaneously with an adjustment of status application provided the spouse entered the U.S. with a visa.

When filing the petition the following documents are needed:

•proof of citizenship for the sponsoring spouse;
•proof of the birth of alien spouse and of divorce(s) or annulment(s) of prior marriages;
•an affidavit of support from the U.S. citizen or if necessary from a co sponsor to prove the poverty guidelines are exceeded;
•a medical exam of the alien;
•proof of lawful entry; and
•evidence of the good faith of the marriage

After the alien relative petition and adjustment application are filed, permission to work will be issued. A request for travel (parole) may be made, but if the applicant overstayed his/her authorized admission, it may involve an issue of excludability. If the applicant committed a crime, it may also affect the immigration process.

An interview will be schedule to verify that the marriage is in good faith.
