Extraordinary Ability Visa

IMMIGRANTS APPLYING FOR A VISA WITH EXTRAORDINARY, AND/OR EXCEPTIONAL RESEARCH ABILITY IN THE NATIONAL INTEREST:

To apply for permanent residence based on extraordinary ability, the applicant must provide proof of higher education, and extraordinary and/or high professional qualifications beyond the ordinary. Exceptional achievement in the arts, sciences, education, business or athletics must be demonstrated.

A Labor Certification is not necessary to satisfy this category.

A job offer is required, however, at the Consular or Immigration interview to prove that the applicant will have work in his/her area of expertise.

Researchers must demonstrate that the work will serve the national interest of the U.S.

After approval of the application the Consulate or Immigration must determine if any grounds of inadmissibility apply.
